The certificate of debts of the community of owners will be an obligatory contribution in the transfer of the properties in horizontal property. However, the parties may expressly waive this. 

El Fifth book of the Civil Code of Catalonia and Law 18/2007 on the Right to Housing They establish that the transmitters of a proprietary element must declare that they are up to date with the payments that correspond to them or, if applicable, they must specify those that are pending and must provide a certificate regarding the status of their debts with the community.

How does the debt certificate of the Community of Owners have to be?

Article 553-5.2 CCCat establishes its essential requirements. The certificate must be issued by the person who exercises the secretariat, and does not require the approval of the presidency if the community administration is carried by a professional who exercises the secretariat. 

The certificate must state if the transferor is up to date with the payments that correspond to him and in addition to common, ordinary and extraordinary expenses, and contributions to the reserve fund approved but pending maturity.
