    Documents needed to Accept an Inheritance

    We offer you a complete list of all the documents necessary to carry out an acceptance of inheritance.

    1- Identification documents of the heirs and legatees

    In order to accept the inheritance, the National Identity Documents (NIE or passport, if applicable) of all the heirs and legatees of the deceased will be necessary, as well as their personal data: marital status, profession and current address.

    2- Death certificate

    The death certificate is the official document that certifies the death of a citizen. The Civil Registries or Spanish consulates are responsible for issuing it, and it contains the following data: the full name of the deceased and his parents, marital status, nationality, birth registration data, last address, day and place of death and place of burial. It can be obtained from the Civil Registry or from the Electronic Headquarters of the Ministry of Justice.

    3- Certificate of last wills

    The certificate of last wills is the document that certifies which wills, codicils and succession agreements were made by the deceased. Through the certificate, the heirs will be able to know where the last will was signed, which will be the valid one, and request an authorized copy of it from the relevant Notary Office. This document is mandatory even if the heirs have this information, to guarantee that the inheritance is accepted with the last will granted. It can be obtained from the Civil Registry or from the Electronic Headquarters of the Ministry of Justice.

    4- Authentic copy of the will

    If you do not have an authentic copy of the deceased's will, you will have to request it from the Notary's Office. To request an authentic copy, the Death Certificate and the Last Will and Testament Certificate are required. If the will is more than 25 years old, you will have to contact the College of Notaries of Barcelona

    5- Deeds and their corresponding IBI receipts (Original)

    The deeds of all the assets or rights of the deceased will have to be submitted to the Notary in order to carry out the inventory.
